Creator Terms of Service

1. Acceptance of Terms

By creating a creator account on Creator VIP, you agree to be bound by these Creator Terms of Service. If you do not agree to these terms, you may not use our creator services.

2. Eligibility

To become a creator on our platform, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Comply with all applicable laws and regulations
  • Provide accurate and truthful information

3. Content Guidelines

3.1 Allowed Content

Creators may publish content that falls within their selected label:

Angel Label (👼):

  • Fashion, editorial, lingerie, and swimwear content
  • Implied sensuality and suggestive poses
  • Artistic photography and lifestyle content
  • No visible genitalia or nipples

Devil Label (😈):

  • All Angel label content
  • Artistic, non-explicit nudity
  • Creative and tasteful adult-oriented content
  • No pornographic or explicit sexual acts

3.2 Prohibited Content

The following content is strictly prohibited:

  • Explicit sexual acts or pornography
  • Nudity showing genitalia in a sexual context
  • Content involving minors in any way
  • Non-consensual content or deepfakes
  • Illegal activities or content
  • Violence, harassment, or hate speech
  • Copyrighted material without proper authorization
  • Misleading or fraudulent content

4. Creator Responsibilities

As a creator, you agree to:

  • Only upload content you own or have rights to distribute
  • Accurately label your content according to platform guidelines
  • Respond to subscriber inquiries in a timely manner
  • Maintain professional conduct with fans and subscribers
  • Not engage in spam, manipulation, or fraudulent activities
  • Comply with all payment and tax obligations
  • Keep your account information secure

5. Revenue and Payments

5.1 Platform Fee

The Archive charges a platform fee of 10% on creator earnings, including:

  • Subscriptions
  • Tips
  • Pay-per-view content purchases
  • Bundle sales
  • Paid messages

Additional payment processing fees, taxes, refunds, or other applicable charges may apply.

5.2 Payouts

  • Payouts are processed through Stripe Connect
  • You must complete Stripe onboarding to receive payments
  • Minimum payout threshold: $50
  • Payment processing time: 2-7 business days
  • You are responsible for all applicable taxes

5.3 Refunds and Chargebacks

  • Subscription refunds are handled per our refund policy
  • Creators may be liable for fraudulent or disputed charges
  • Excessive chargebacks may result in account suspension

6. Intellectual Property

6.1 Your Content

You retain all ownership rights to your content. By uploading content, you grant Creator VIP a non-exclusive license to:

  • Display, store, and distribute your content on our platform
  • Promote your content in platform marketing materials
  • Process and optimize content for platform functionality

6.2 Platform Rights

Creator VIP owns all rights to the platform, including design, code, and branding. You may not copy, modify, or distribute any platform materials.

7. Account Suspension and Termination

7.1 Violations

We reserve the right to suspend or terminate your account for:

  • Violation of these terms or community guidelines
  • Fraudulent or illegal activity
  • Repeated policy violations
  • Excessive chargebacks or payment issues
  • Complaints or reports from users

7.2 Voluntary Termination

You may deactivate or delete your account at any time through Creator Settings. Upon deletion:

  • Your profile and content will be removed
  • Active subscriptions will continue until expiration
  • You forfeit access to pending payments below the minimum threshold

8. Disputes and Resolution

Any disputes arising from these terms shall be resolved through:

  1. Good faith negotiation
  2. Binding arbitration if necessary
  3. Governed by the laws of [Jurisdiction]

9. Limitation of Liability

Creator VIP is not liable for:

  • Loss of income or earnings
  • Content theft or unauthorized distribution
  • Technical issues or platform downtime
  • Disputes between creators and fans
  • Tax obligations or legal issues

10. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email. Continued use of the platform constitutes acceptance of updated terms.
